| In Michigan, a client can obtain representation on either a contingency or hourly basis for a personal injury case. | |||
| A Contingency fee basis is the situation in which an attorney accepts a case with the agreement that he or she will be paid for the time that they expend upon a case by way of a percentage of the amount recovered, usually 1/3. That is often an attractive agreement to a client since they do not risk any funds for attorney fees if a case is not successful. However, you should realize that a competent, experienced attorney would not be willing to accept a case and spend substantial time thereon unless he or she thought there would be a good chance for a recovery. If I elect to accept the representation of a case, then I am generally willing to do so on a contingency basis. | |||
| The second method is to pay an attorney on an hourly basis regardless of the outcome. Therefore, if an attorney expends 150 hours upon a file and there is not a successful result then the client is still obligated to pay the attorney fee. This is generally not the method that most personal injury clients retain their attorneys by. Regardless of the method in which you choose to retain an attorney, the client is obligated to pay the out-of-pocket costs thereon, regardless of the outcome. These costs generally come out of the settlement. | |||
