| An owner of land, property, homes, stairs, stores, etc., owes certain duties to individuals upon their property. As an example; an owner of a business has a duty to maintain the business in a reasonably safe condition. A reasonably safe condition means that there can not be slippery substances upon a walking area if the owner or proprietor knew or should have known of the condition. In fact they have an actual duty to exercise ordinary care to protect a customer or guest from unreasonable risk of injury that was or should have been known. Likewise, the lack of handrails along stairs would also be reason to possibly pursue a cause of action if indeed the missing handrail caused or contributed to the fall. | |||
